By accessing or using any MitosSoft product or service, you agree to be bound by these Terms of Service. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
MitosSoft provides enterprise software-as-a-service products including MitosSense, MitCat, MitCart, MitDay, MitOne, and MitASec. Each product is subject to its specific service-level agreement and acceptable use policies.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. MitosSoft is not liable for losses arising from unauthorized access to your account.
You agree not to use our services for any unlawful purpose, to violate any regulations, to infringe on intellectual property rights, to transmit malicious code, to attempt unauthorized access, or to interfere with the proper functioning of our platform.
All MitosSoft products, logos, documentation, and related materials are the intellectual property of MitosSoft. Your subscription grants you a limited, non-exclusive, non-transferable license to use our services. You retain ownership of all data you upload to our platform.
Subscription fees are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as specified in your service agreement. We reserve the right to modify pricing with 30 days notice.
MitosSoft commits to 99.9% uptime for all products. Scheduled maintenance windows are communicated 48 hours in advance. Service credits are issued automatically for downtime exceeding our SLA commitments.
Either party may terminate the subscription with 30 days written notice. Upon termination, you may export your data within 30 days. After this period, data is permanently deleted in accordance with our data retention policy.
MitosSoft's total liability is limited to the amount paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages arising from the use of our services.
These terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved through binding arbitration in Istanbul, except where injunctive relief is sought.
